Abstract:
The legitimacy of arbitration rests on the independence of arbitral tribunals and the integrity of the awards they write. Yet, recent rulings by the top court in Singapore annulling two arbitral awards, due to the extensive ‘copy-paste’ by retired judges acting as arbitrators, raise important questions about the line between arbitral efficacy and impropriety.
This talk, the fifth in the series of Dispute Resolution Dialogues at TrustBridge, will critically examine the phenomenon of judicial plagiarism in arbitration: how it manifests, why it matters, and what its implications are for the legitimacy and enforceability of arbitral awards.
